Deadlines that apply to you
These are the dates that end claims. Check them first.
If the injury happened on a municipal road or sidewalk and the claim is that it was not kept in repair, written notice must reach the municipality within 10 days.
Municipal Act, 2001, S.O. 2001, c. 25, s. 44(10)
In most Ontario claims you have two years from the day you knew, or ought to have known, that you had a claim.
Limitations Act, 2002, S.O. 2002, c. 24, Sched. B, s. 4
Injured in Markham
Markham has one of the most linguistically diverse populations in the country, and that matters more to an injury claim than it sounds. Insurer correspondence arrives in English, medical assessments are conducted in English, and a claimant working in a second language is at a measurable disadvantage in exactly the moments that decide a file.
The municipal structure is the York Region model. The City of Markham owns local streets and sidewalks, York Region owns the regional roads, and the 10-day notice goes to whichever one owns the stretch you were on.
Have someone read the insurer letters properly
Correspondence, medical assessments and benefit denials arrive in English on a fixed clock. A missed deadline in a letter nobody fully read is the most avoidable way a good claim is lost.
Serve the City and York Region both
Markham maintains local streets and sidewalks, York Region maintains regional roads. Both notices run 10 days, and where ownership is unclear the safe course is to serve each of them.
Keep the YRT or Viva details
Those services are operated by the Region rather than the City, so a transit injury is a claim against a different body than a sidewalk fall on the same street. Route, run time and incident number all matter.
The law is the same across Ontario. Who you serve is not.
Markham is a lower-tier municipality inside York Region. Notice goes to the City of Markham for local roads and sidewalks, and to York Region for regional roads.
WRITTEN NOTICE GOES TO
- City Clerk, City of Markham
- Regional Clerk, York Region
If the injury happened on a municipal road or sidewalk and the claim is that it was not kept in repair, written notice must reach the municipality within 10 days.
Municipal Act, 2001, S.O. 2001, c. 25, s. 44(10)
Superior Court of Justice, Newmarket
50 Eagle Street West, Newmarket
York Region claims, including Markham claims, are issued in the Superior Court of Justice at Newmarket.
York Region Transit and Viva
York Region Transit and the Viva routes are operated by the Region. An injury on one of those vehicles is a claim against York Region rather than against the City of Markham.
Markham Stouffville Hospital
Markham Stouffville Hospital handles emergency care locally, with severe trauma generally transferred to a designated lead trauma centre in Toronto.
Highway 404, Highway 407, Highway 7
Highway 404 and the 407 bound Markham and Highway 7 runs through it. Regional ownership of the major arterials is what decides where a notice goes.
What this costs you
We fight for the maximum compensation your claim will carry, and you do not pay a dollar unless we win.
Nothing up front. The consultation is free, we act on contingency, and we advance the costs of building the case so a claim is never held up by money. If we do not recover anything, you do not owe a fee.

Questions we get every week
Whichever owns the road. The City maintains local streets and sidewalks, the Region maintains regional roads. Where you cannot tell, serve both inside the 10 days.
In the Superior Court of Justice at Newmarket, which is the registry for all of York Region.
We can take instructions and explain the file in the language you are comfortable in. What cannot change is that insurer correspondence, medical assessments and court documents are in English, which is exactly why having somebody read them properly matters.
No. The 10-day municipal notice and the two-year limitation period are provincial. What differs is which government receives the notice.

The limitation period, the statutory deductible and the tort threshold are provincial, so they are identical in every city here. What changes is who must be served inside the 10-day notice window, and that is decided by the city.
