Insurance Dispute Lawyers in Ontario
Ontario insurers owe policyholders a duty of good faith in how they handle a claim. A denial is a position taken by an adjuster, not a final ruling, and denials are overturned regularly.
Deadlines that apply to you
These are the dates that end claims. Check them first.
In most Ontario claims you have two years from the day you knew, or ought to have known, that you had a claim.
Limitations Act, 2002, S.O. 2002, c. 24, Sched. B, s. 4
How this actually works
A denial letter is written to sound final. It is not. It is one party to a contract stating its position.
We deal with denied, delayed and underpaid claims across accident benefits, disability, property and life insurance. The pattern is usually the same: a decision made on a paper review, resting on a policy term the insurer is reading more narrowly than it reads.
Where an insurer has handled a claim in bad faith, that can itself attract additional damages beyond the amount of the claim.
Read the policy against the letter
The denial tells you what they decided. The policy tells you what they were entitled to decide. The gap is the case.
Get the claim file
Adjuster notes, internal medical reviews and the instructions given to assessors. What is in that file often differs from what is in the letter.
Meet the stated reason directly
Whether that is a medical opinion, a policy exclusion, or an allegation about the application. Each has a different answer.
Escalate where it is warranted
Some disputes belong at a tribunal, some in court, and some resolve once the insurer sees the file is being run properly.
What this costs you
We fight for the maximum compensation your claim will carry, and you do not pay a dollar unless we win.
Nothing up front. The consultation is free, we act on contingency, and we advance the costs of building the case so a claim is never held up by money. If we do not recover anything, you do not owe a fee.

Questions we get every week
They can take a position, but they owe a duty of good faith in how they investigate and decide. A denial is the start of a dispute, not the end of one.
Handling a claim unreasonably, such as ignoring evidence, delaying without cause or relying on a review that was never going to find in your favour. It can attract damages beyond the claim itself.
Generally two years, though when the clock starts can be argued about and some policies contain their own shorter terms. Do not rely on the date in the letter without checking.
That is a common worry and it is not a reason to accept a wrongful denial. Enforcing a contract you paid for is not misconduct.
The consultation is free and these are generally taken on contingency.
