Deadlines that apply to you
These are the dates that end claims. Check them first.
If the injury happened on a municipal road or sidewalk and the claim is that it was not kept in repair, written notice must reach the municipality within 10 days.
Municipal Act, 2001, S.O. 2001, c. 25, s. 44(10)
In most Ontario claims you have two years from the day you knew, or ought to have known, that you had a claim.
Limitations Act, 2002, S.O. 2002, c. 24, Sched. B, s. 4
Injured in London
London is a single-tier city, so the municipal side is straightforward. One road authority, one clerk, one notice within 10 days.
The distinctive thing about a London file is the medicine. This is a teaching hospital city with a designated trauma centre and a research culture around it, and that produces medical records that are more detailed than what comes out of a community hospital. That cuts both ways. A well-documented injury is easier to prove, and it is also easier for an insurer's expert to pick apart. Either way the file is won or lost in those records.
Highway 401 and Highway 402 meet here, which means a share of the serious collision work involves long-haul traffic, out-of-province insurers, and commercial policies rather than ordinary auto coverage.
Get the full hospital file, not the summary
A teaching hospital produces far more detail than a community hospital. That detail helps prove the injury, and it gives an insurer's expert more to work with, so all of it needs reading.
Serve the City of London within 10 days
London is single-tier, so there is one road authority and one clerk to serve. The notice must be in writing and it must arrive inside the window.
Move fast if a commercial vehicle was involved
The 401 and 402 meet here, and a carrier will often have its own investigators at the scene the same day. Driver logs and vehicle data are preserved only if somebody asks for them in writing early.
The law is the same across Ontario. Who you serve is not.
London is a single-tier municipality. The City of London is the road authority for city streets and sidewalks, so notice under the Municipal Act goes to the City Clerk.
WRITTEN NOTICE GOES TO
- City Clerk, City of London
If the injury happened on a municipal road or sidewalk and the claim is that it was not kept in repair, written notice must reach the municipality within 10 days.

Superior Court of Justice, London
80 Dundas Street, London
A London tort claim is issued in the Superior Court of Justice at London.
London Transit Commission
The London Transit Commission operates the city's buses as a separate corporate body, so an injury on an LTC vehicle is a claim against the Commission in its own name. The Commission is also the City's agent, so the safe course is to notify the City of London as well.
London Health Sciences Centre, Victoria Hospital
Victoria Hospital is the designated lead trauma centre for southwestern Ontario. Serious injuries from a wide surrounding area are treated and documented there.
Highway 401, Highway 402, Veterans Memorial Parkway
The 401 and the 402 meet at London, which puts long-haul commercial traffic on the same roads as local drivers and frequently brings commercial insurance policies into a claim.

We fight for the maximum compensation your claim will carry, and you do not pay a dollar unless we win.
Nothing up front. The consultation is free, we act on contingency, and we advance the costs of building the case so a claim is never held up by money. If we do not recover anything, you do not owe a fee.

Questions we get every week
The City of London. London is single-tier, so there is one road authority and one clerk. The notice must be in writing and reach the City within 10 days.
It usually changes who pays and how hard they fight. Commercial policies carry higher limits, and the carrier will often have its own investigators on the scene the same day. That makes early evidence preservation more important, not less.
The records are generally more detailed, which helps prove the injury. It also gives an insurer's expert more material to work with, so detailed records are an advantage only if somebody reads all of them properly.
No. The limitation period, the deductible, the tort threshold and accident benefits are provincial. What differs is the road authority, the courthouse and the hospital network.

The limitation period, the statutory deductible and the tort threshold are provincial, so they are identical in every city here. What changes is who must be served inside the 10-day notice window, and that is decided by the city.
