Wrongful Death Lawyers in Ontario
Ontario's Family Law Act allows a spouse, children, parents, grandparents and siblings to claim for the loss of care, guidance and companionship, along with financial dependency and funeral costs.
Deadlines that apply to you
These are the dates that end claims. Check them first.
In most Ontario claims you have two years from the day you knew, or ought to have known, that you had a claim.
Limitations Act, 2002, S.O. 2002, c. 24, Sched. B, s. 4
How this actually works
There is no version of this that a legal process makes better. What it can do is make sure a family is not also dealing with financial collapse while they grieve.
Ontario allows a defined group of family members to bring their own claims. That covers the loss of the relationship itself, the income the family depended on, the care and services the person provided, and funeral expenses.
These files are run quietly. Families are not asked to relive the event more often than the case genuinely requires.
Confirm who can claim
Spouse, children, grandchildren, parents, grandparents and siblings each have standing under the Family Law Act, and each claim is assessed separately.
Establish what happened
Often alongside a police investigation or a coroner's process. We work around those rather than through the family.
Assess dependency
Income the household relied on, and the value of what the person did that now has to be paid for or gone without.
Resolve it without dragging the family through it
Most of these settle. Where a trial is genuinely necessary we prepare for it, but we do not use the family as leverage.
What this costs you
We fight for the maximum compensation your claim will carry, and you do not pay a dollar unless we win.
Nothing up front. The consultation is free, we act on contingency, and we advance the costs of building the case so a claim is never held up by money. If we do not recover anything, you do not owe a fee.

Questions we get every week
Spouses, children, grandchildren, parents, grandparents and siblings of the person who died, under the Family Law Act.
Generally two years. Where a criminal investigation is running it can feel too early to think about, but the limitation period continues to run alongside it.
They are separate processes with different standards of proof. A civil claim can succeed regardless of what happens in the criminal court.
Loss of care, guidance and companionship, loss of financial support, the value of services the person provided, and funeral and related expenses.
Usually not. Most of these resolve without a trial.

The limitation period, the statutory deductible and the tort threshold are provincial, so they are identical in every city here. What changes is who must be served inside the 10-day notice window, and that is decided by the city.
