Product Liability Lawyers in Ontario
If a defective or unreasonably dangerous product injured you, the manufacturer, distributor or retailer may be liable. The single most important step is keeping the product, its packaging and any instructions exactly as they are.
Deadlines that apply to you
These are the dates that end claims. Check them first.
In most Ontario claims you have two years from the day you knew, or ought to have known, that you had a claim.

How this actually works
The advice that matters most in a product case is practical: do not throw it away, do not send it back, and do not let anyone take it for testing without an agreement about how that testing happens.
Claims can rest on a manufacturing defect, a design that was unreasonably dangerous, or a failure to warn about a risk the maker knew about. Each is proved differently.
Manufacturers routinely ask for the item back for inspection. Handing it over without terms is how the key evidence in a case disappears.
Preserve everything
The product, packaging, manuals, receipts and any correspondence. Photograph it all before anyone touches it.
Identify the failure
Manufacturing defect, design defect, or inadequate warning. These are different claims with different evidence.
Find the pattern
Recalls, regulator notices, complaint databases and prior claims. A history of the same failure changes the case substantially.
Independent testing on agreed terms
Any examination happens under a protocol both sides accept, so the item is not altered or lost.
What this costs you
We fight for the maximum compensation your claim will carry, and you do not pay a dollar unless we win.
Nothing up front. The consultation is free, we act on contingency, and we advance the costs of building the case so a claim is never held up by money. If we do not recover anything, you do not owe a fee.

Questions we get every week
Not without an agreement about how it will be examined and preserved. Once it is gone, so is the case.
Not fatal. Purchase can often be established from card records, account history or the packaging itself.
It can be significant, though a recall is not automatically an admission. It does tend to establish that the risk was known.
Reasonably foreseeable misuse is part of what a manufacturer is expected to design for. It may affect the share of responsibility rather than end the claim.
Potentially the manufacturer, the distributor and the retailer. Working out which one is our job, not yours.
