SIDHUINJURY LAWYERS

Personal Injury Lawyers in Mississauga

Mississauga sits inside the Region of Peel, which makes it two-tier. A fall on a city road is served on the City of Mississauga and a fall on a regional road is served on the Region of Peel. Both deadlines are 10 days, and getting the wrong one is the mistake that ends claims here.

Deadlines that apply to you

These are the dates that end claims. Check them first.

10days

If the injury happened on a municipal road or sidewalk and the claim is that it was not kept in repair, written notice must reach the municipality within 10 days.

Municipal Act, 2001, S.O. 2001, c. 25, s. 44(10)

2years

In most Ontario claims you have two years from the day you knew, or ought to have known, that you had a claim.

Limitations Act, 2002, S.O. 2002, c. 24, Sched. B, s. 4

Injured in Mississauga

The thing that catches people in Mississauga is that there are two governments, and the one you serve depends on which road you were standing on.

Mississauga is inside the Region of Peel. The City maintains local streets and sidewalks. The Region maintains the arterial roads that carry most of the traffic. They are different legal entities with different clerks, and a notice served on the wrong one is not a notice.

Ten days is not long enough to research municipal boundaries while you are injured. Where there is any doubt about which authority owns the road, serve both. It costs nothing and it protects the claim.

1

Photograph where you were standing

Not just the hazard. The surroundings are what later establish whether that stretch of road belonged to the City or to the Region, and the photographs are usually the only record of it.

2

Work out whose road it was, then serve both anyway

The City maintains local streets and sidewalks, the Region maintains regional roads. Ten days is not long enough to resolve a boundary question while injured, and serving both costs nothing.

3

Get the MiWay incident number

If it happened on a bus, the operator files a report and the vehicle carries cameras. Ask for the incident number at the time. It is far harder to locate the right vehicle and the right run weeks later.

What is different in Mississauga

The law is the same across Ontario. Who you serve is not.

Two-tier: Mississauga sits inside Region of Peel

Mississauga is a lower-tier municipality inside the Region of Peel. The City is the road authority for local streets and sidewalks. The Region is the road authority for regional roads. Notice goes to whichever one owns the road, and where that is unclear, to both.

WRITTEN NOTICE GOES TO

  • City Clerk, City of Mississauga
  • Regional Clerk, Region of Peel

If the injury happened on a municipal road or sidewalk and the claim is that it was not kept in repair, written notice must reach the municipality within 10 days.

Municipal Act, 2001, S.O. 2001, c. 25, s. 44(10)

WHERE THE CLAIM IS ISSUED

Superior Court of Justice, Brampton

7755 Hurontario Street, Brampton

Peel Region claims are issued in the Superior Court of Justice at Brampton, not in Mississauga. People are regularly surprised that a Mississauga claim is a Brampton file.

LOCAL TRANSIT

MiWay

MiWay is operated by the City of Mississauga. An injury on a MiWay bus is a claim against the City, which means the municipal notice rules are in play from the first day.

TRAUMA AND MAJOR INJURY CARE

Trillium Health Partners

Trillium Health Partners runs the Mississauga Hospital and Credit Valley Hospital. The most severe trauma is typically transferred to a designated lead trauma centre, which means the records for a catastrophic file sit in two hospital systems rather than one.

ROADS WE ARE CALLED ABOUT MOST

Highway 401, Highway 403, the QEW, Hurontario Street

Four major highways cross Mississauga and Hurontario runs the length of it. A collision here is often on a road the Region owns rather than the City.

What this costs you

We fight for the maximum compensation your claim will carry, and you do not pay a dollar unless we win.

Nothing up front. The consultation is free, we act on contingency, and we advance the costs of building the case so a claim is never held up by money. If we do not recover anything, you do not owe a fee.

COMMON QUESTIONS

Questions we get every week

It depends on who owns the road. The City maintains local streets and sidewalks, the Region maintains regional roads. If you cannot tell, serve both inside the 10 days. Meeting the shorter deadline twice costs nothing and protects the claim.

Peel Region claims are issued in the Superior Court of Justice at Brampton. The courthouse follows the region, not the city you live in.

Yes. MiWay is run by the City of Mississauga, so it is a claim against a municipality and the notice rules apply. Your accident benefits still come from your own auto insurer, or from the transit operator where you have no policy of your own.

A private parking lot is occupiers' liability rather than municipal, and the notice period is different. Where a fall happened near the boundary between a sidewalk and private property, give notice under both rules.

Other Ontario cities we act in

The limitation period, the statutory deductible and the tort threshold are provincial, so they are identical in every city here. What changes is who must be served inside the 10-day notice window, and that is decided by the city.
