Deadlines that apply to you
These are the dates that end claims. Check them first.
If the injury happened on a City of Toronto road or sidewalk and the claim is that it was not kept in repair, written notice must reach the City within 10 days. Toronto is the only Ontario municipality outside the Municipal Act, so the requirement comes from the City of Toronto Act instead.
City of Toronto Act, 2006, S.O. 2006, c. 11, Sched. A, s. 42
In most Ontario claims you have two years from the day you knew, or ought to have known, that you had a claim.

Injured in Scarborough
This is the page for our office. We are on Eglinton Avenue East, east of Kennedy Station, and you can meet a lawyer here by appointment. If getting here is hard, we come to you, at home or in hospital.
Many people still think of Scarborough as its own city. For an injury claim it is not. It has been part of the City of Toronto since January 1, 1998, so the City of Toronto is the road authority, the City of Toronto Act sets the notice rule, and a lawsuit is issued in the Superior Court in downtown Toronto.
Get every hospital record
If you were seen at Birchmount, Centenary or General and then transferred, each hospital holds part of the story. The claim needs all of them, and the ambulance call report too.
Serve the City of Toronto within 10 days
Scarborough is part of Toronto, so the notice for a fall on a city road or sidewalk goes to the City of Toronto, under the City of Toronto Act. The clock is still 10 days.
Secure the footage and the report
Traffic cameras, TTC bus cameras and nearby businesses record over their footage on their own schedules, often inside two weeks. A written request in the first days keeps it.
The law is the same across Ontario. Who you serve is not.
Scarborough has been part of the City of Toronto since January 1, 1998. The City of Toronto is the road authority for Scarborough streets and sidewalks, and the 10-day written notice for a fall runs under the City of Toronto Act, not the Municipal Act.

Superior Court of Justice, Toronto
393 University Avenue, Toronto
Scarborough is inside the City of Toronto, so a tort claim from here is issued in the Superior Court of Justice at Toronto.
Toronto Transit Commission
Line 3 Scarborough trains stopped permanently in 2023, and buses now carry that route between Kennedy and Scarborough Centre. An injury on a TTC bus, at a stop or in a station is a claim against the Commission and follows its own notice path, separate from the road authority.
Scarborough Health Network
Scarborough Health Network runs the area's three hospitals: Birchmount, Centenary and General. Sunnybrook and St. Michael's are the region's adult lead trauma centres, and where someone is transferred, the claim needs the records from every hospital involved.
Highway 401, Kingston Road, Eglinton Avenue East
Highway 401 crosses Scarborough from end to end, and Kingston Road and Eglinton Avenue East run the width of it. On fast, multi-lane roads like these, the police collision report and nearby camera footage are the first things to secure.
Scarborough follows Toronto's rules. Who to serve, which court and how TTC claims work are set out in full on our Toronto page. Read the Toronto page
